Beltronics Extended Service Plan

This document contains the Terms and Conditions of the BELTRONICSA Extended Service Agreement (hereinafter referred to as "Agreement") between the original purchaser (hereinafter referred to as "CUSTOMER") and BELTRONICS (hereinafter referred to as "BELTRONICS") for the radar detector or Vehicle Performance Computer product (hereinafter referred to as "Product").

1. PERIOD OF COVERAGE

1. This Agreement shall commence on the date of purchase of the Agreement and shall terminate on the third anniversary of the original date of purchase of the Product.

2. EQUIPMENT ELIGIBLE FOR SERVICE

1. Only the original Product sold new with a warranty is eligible for Service under this Agreement.
2. The Product must be in proper operating condition on the date of purchase of this Agreement.

3. SERVICE PROVIDED

1. BELTRONICS agrees to either, at its option, replace the Product or to furnish labor and parts as deemed necessary by BELTRONICS to maintain the Product in proper operating condition during the term of this Agreement, subject to the terms and conditions contained herein.
2. CUSTOMER must deliver the Product (freight prepaid), with the ESP sticker attached, to BELTRONICS.

4. EXCLUSIONS FROM SERVICE

1. Service provided under this Agreement is contingent upon the proper use of the Product in an appropriate operating environment. This Agreement does not cover: (1) damage to the Detector due to accident, neglect, misuse, fire, water, damage or fluctuation of vehicle electrical system including but not limited to the battery, alternator, etc., damage resulting from batteries and/or accessories not manufactured by BELTRONICS, or attachments; (2) Service which is required to comply with changes in the laws or regulations of any governmental body or agency; (3) Service performed by personnel other than BELTRONICS Service personnel.
2. BELTRONICS reserves the right to refuse to perform Service where the Product has been altered, modified or serviced by someone other than BELTRONICS or where the serial number and or ESP sticker has been tampered with or is missing and the Product can not be identified.
3. CUSTOMER agrees to pay for service not covered by this Agreement at BELTRONICS current rates for service.

5. REPLACEMENT OF PARTS/PRODUCT

1. If service requires the replacement of any parts, components, circuit boards, units, modules or Product, the replacement items become the property of CUSTOMER and the replaced items become the property of BELTRONICS.

6. LIMITATION OF LIABILITY

1. BELTRONICS sole responsibility under this Agreement shall be limited to providing Service by repair or replacement of the Product at BELTRONICS election. BELTRONICS SHALL HAVE NO OTHER LIABILITY OR RESPONSIBILITY TO THE CUSTOMER OR ANY OTHER PERSON OR ENTITY WITH RESPECT TO ANY LIABILITY, LOSS, OR DAMAGE CAUSED OR ALLEGED TO BE CAUSED DIRECTLY OR INDIRECTLY BY BELTRONICS, BELTRONICS REPLACEMENT PARTS OR DETECTOR, OR SERVICE PROVIDED BY BELTRONICS, IN NO EVENT SHALL BELTRONICS BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THIS AGREEMENT. Some states do not allow the limitation or exclusion of incidental or consequential damages; therefore, the aforesaid limitation(s) or exclusion(s) may not apply to CUSTOMER.

7. GENERAL

1. THIS AGREEMENT (INCLUDING THIS PARAGRAPH) MAY NOT BE MODIFIED EXCEPT IN WRITING SIGNED BY BELTRONICS CONTRACT DEPARTMENT PERSONNEL IN WEST CHESTER, OHIO. NO OTHER BELTRONICS EMPLOYEE IS AUTHORIZED TO MODIFY THIS AGREEMENT OR TO MAKE ANY REPRESENTATIONS OR AGREEMENTS, WRITTEN OR ORAL, CONCERNING THIS SUBJECT MATTER HEREIN, AND NO SUCH MODIFICATION, REPRESENTATION OR AGREEMENT SHALL BE BINDING UPON BELTRONICS.
2. BELTRONICS reserves the right to subcontract any Service under this Agreement.
3. This Agreement is valid only in the United States.
